FWP seeks public input on Stream Protection Act permit review >

HELENA – FWP invites the public to review and comment on an updated programmatic environmental assessment (PEA) that examines how projects in and around Montana’s streams are reviewed and permitted under the Stream Protection Act (SPA). FWP completed a previous PEA in 2015, which evaluated a narrower scope of routine actions. 

Every year, state agencies, counties, municipalities, and other public entities complete hundreds of projects in Montana’s rivers and streams – building or repairing bridges and culverts, stabilizing streambanks, improving fish habitat, responding to emergencies, or clearing debris after storms. These projects are essential for public safety, transportation, and community infrastructure, but they can also affect fish, wildlife, water quality, and riparian vegetation.

 The draft PEA provides a statewide, comprehensive evaluation of the potential environmental impacts associated with issuing SPA permits. By completing this broader assessment, FWP aims to streamline permit processing, comply with competing statutory timelines, and continue safeguarding Montana’s aquatic habitats.

The Montana Environmental Policy Act (MEPA) requires state agencies to evaluate the potential environmental effects of their actions and provide the public with an opportunity to review and comment. MEPA also allows agencies to conduct programmatic environmental reviews when many similar actions occur statewide.

By establishing this broad environmental review, FWP can rely on the programmatic assessment for most permit decisions, while still retaining the ability – and responsibility – to require more detailed analysis for unique or potentially significant projects. This approach is fully consistent with MEPA and strengthens both environmental protection and administrative efficiency.
